Biography

Todd McGarvey’s practice focuses on defending private and public entities in employment and personal injury matters. Mr. McGarvey has extensive experience with claims of discrimination, harassment, and retaliation brought under Title VII, the ADA, the LAD, and CEPA. In addition, Mr. McGarvey routinely represents clients in tort-based actions involving catastrophic personal injuries. He routinely appears in courts throughout the State of New Jersey, including federal and state trial courts, the Appellate Division, and the New Jersey Supreme Court.

Before joining Anderson & Shah, Mr. McGarvey worked at a prominent Philadelphia law firm defending businesses and individuals in toxic tort, products liability, and premises liability claims.

Representative Cases
  • C.S. & G v. Bridgewater-Raritan Reg’l Sch. Dist. Bd. of Educ., 2023 N.J. Super. Unpub. LEXIS 175 (App. Div. Feb. 8, 2023), cert denied, 294 A.3d 265 (2023): obtained summary judgment dismissing LAD discrimination and hostile school environment claims against a guidance counselor and school district. Successfully defended the judgment on appeal.
  • C.W. v. Roselle Bd. of Educ., 474 N.J. Super. 644 (App. Div. 2023): successfully defended on appeal the trial court’s interlocutory order dismissing former student’s claim for pain and suffering damages for failure to show medical expenses in excess of $3600.
  • Successfully defended a $2.5 million arbitration demand arising out of a playground accident involving catastrophic personal injuries sustained by a 10-year-old boy.
  • Obtained defense and indemnification for a school district from a contractor and its insurer in connection with a wrongful death suit bought by the estate and decedents of a 39-year-old construction worker.
